These Terms of Service ("Terms") are an agreement between you and OrganizeOS LLC, a Pennsylvania benefit company ("OrganizeOS," "we," "us"). They cover your use of the OrganizeOS platform at app.organizeos.org, the OrganizeOS mobile and desktop apps, our website at organizeos.org, and the pages we host for organizations (together, the "Service"). Our Privacy Policy explains how we handle personal information and is part of these Terms.
There are two ways to use the Service:
You must give accurate information, keep your password secure and tell us at once about any unauthorized use of your account. You are responsible for activity under your account. You must be at least 13 years old to create an account, and if you are under 18, you need a parent or guardian's permission where the law requires it.
OrganizeOS is in beta, and organizations join by application. We review each application, and each organization before its public pages and payments go live, and we may ask for information to verify who you are and what your organization does. We may decline an application, and we decide applications against the same standards that apply to every organization on the Service (sections 4, 8 and 9).
Tools labelled Beta work but are still being finished; tools labelled Coming soon are not available. Features may change, and we may add, change or remove them.
OrganizeOS is independent and non-partisan. We serve organizations across the political spectrum, and campaigns, parties and other political organizations may use the Service for their own lawful political work on the same terms as everyone else. Using the Service does not mean OrganizeOS supports your organization, your positions or your candidates, and the same is true for every other organization on it.
You may not:
Nothing in this section limits what an organization says about politics on its own pages, to its own lists or in its own spaces. We apply this section the same way to every party, faction and position. Breaking it is a breach of these Terms, handled under section 9.
An organization owns the information it puts into or collects through its workspace about its members, supporters, donors, volunteers and contacts ("Organization Data"). The organization is responsible for:
For Organization Data, OrganizeOS acts as the organization's service provider. We:
Organizations and their people. OrganizeOS is not a party to the relationship between an organization and its members, supporters, donors or volunteers. Membership terms, dues, refunds, donations, event policies and disputes about them are between the organization and its people, and the organization's own policies apply. If you join an organization, it can see the information you share with it, as the Privacy Policy explains.
You keep ownership of what you post or upload ("Your Content"). You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display and transmit Your Content only as needed to provide and maintain the Service as the Privacy Policy describes, and as the visibility settings you or your organization choose allow. You confirm you have the rights to Your Content.
You may not use the Service to:
To report content that infringes your copyright, or anything else that breaks these Terms, email privacy@organizeos.org.
We do not serve an organization whose purpose, or whose regular activity, is any of the following:
How we apply this section. We look at what an organization does and what it says its purpose is: its own statements, materials and public conduct, and what people do in its name with its approval. Our approach is not to decline or remove an organization because its views are unpopular, controversial or held by few people, including strong positions on contested political, religious or social questions: holding a view is not a reason to be removed; acting against people is. Decisions under this section are ours to make, and this description of our approach does not give anyone a claim against us.
Who decides. Reports, automated flags and our own review reach a case queue reviewed by people at OrganizeOS. A decision to suspend or remove an organization under section 4 or 8 is made by a person, not by an automated system, and we record the rule it rests on.
What we may do, in proportion to what happened: remove or hide content; turn off a feature for an organization (for example its communities or its public pages); suspend an account or an organization; or end an account's or an organization's use of the Service.
Notice. We tell the account holder or the organization's owner what we did, which part of these Terms it rests on and, where it applies, how to fix it. We may act first and explain afterward when the law requires it, when someone is at risk of harm, or when warning would let the harm continue.
Appeal. An organization's owner can appeal a suspension or removal within 30 days through the appeal option in the Service or by emailing privacy@organizeos.org. Where we can, someone who did not make the first decision reviews the appeal, and we tell you the outcome. An appeal does not pause a suspension while it is reviewed.
Your data after removal. When we end an organization's use of the Service, its owner can ask us for an export of its Organization Data within 30 days, unless the law prevents it or the data is itself the problem (for example unlawful content).
Donations, dues and purchases made through an organization's pages go to that organization through our payment processor. The organization, not OrganizeOS, is the recipient and is responsible for receipts, refunds, tax treatment and any disclosure or compliance duty that applies to it, including federal and state campaign finance rules. The payment processor's own terms also apply.
OrganizeOS deducts a platform fee from payments made to an organization through the Service, such as donations and shop purchases, at the rate for the organization's plan shown in its billing settings, in addition to the payment processor's own fees. Donors may choose to cover these fees where the organization offers it. We will tell organizations in advance before we raise a rate, and a higher rate applies only after that notice.
The Service, including its software, design and the OrganizeOS name and logo, belongs to OrganizeOS LLC. These Terms give you no right to use our name or logo except where the Service itself displays them. We may use feedback you send us without any obligation to you.
The Service relies on third parties, including the service providers the Privacy Policy describes. Services you choose to connect are governed by their own terms. We are not responsible for third-party services.
You can stop using the Service at any time and delete your account as the Privacy Policy describes. An organization can export its data and close its workspace. We may suspend or end access for a breach of these Terms, for a legal requirement, or to protect people or the Service, as section 9 describes.
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We do not promise that the Service will be uninterrupted or error-free, or that it meets any organization's legal or compliance obligations.
To the fullest extent the law allows, OrganizeOS is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, and our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US$100. Some places do not allow these limits, so they may not apply to you.
An organization will defend and indemnify OrganizeOS against third-party claims arising from its Organization Data, the content it publishes, the messages and calls it sends, the payments it accepts and its compliance with the laws that apply to it (including privacy, messaging, tax and campaign finance law), except to the extent a claim is caused by OrganizeOS's own breach of these Terms. We will tell the organization promptly about the claim, let it control the defense and cooperate reasonably, and it will not settle a claim that admits fault for OrganizeOS without our consent.
Pennsylvania law governs these Terms, without regard to its conflict-of-laws rules. Before filing a claim, you agree to email privacy@organizeos.org and try to resolve the dispute informally for 30 days. If it is not resolved, the state or federal courts located in Pennsylvania have exclusive jurisdiction, and you and we consent to them, except that either of us may bring a qualifying claim in small claims court.
We will post changes here and update the date at the top. For material changes, we will notify account holders by email or in-app notice before the change takes effect. Continuing to use the Service after a change takes effect means you accept it.
